Federal prosecutors and California state officials are locked in a dispute over a list of roughly 20,000 ballots. The Justice Department sent a letter on Friday demanding that election authorities verify the citizenship status of these voters within 48 hours. The deadline lands less than two weeks before the midterm elections, creating a tight window for local staff to process the data.

The 20,000 figure represents the number of ballots tied to suspected noncitizens on the federal list. While noncitizen voting is rare, the Justice Department has increased its prosecutions of alleged illegal voters in recent weeks. Federal prosecutors stated they are asking county officials to provide necessary information so the Department of Homeland Security can quickly verify status. They described the goal as ensuring the most secure election in California history.

State leaders argue the timeline is too short and the data is flawed. Attorney General Rob Bonta said the administration is politicizing and weaponizing the law. He told MS Now that the Department of Justice is acting at the direction of President Donald Trump. Bonta noted that officials were given only names without any explanation of why those specific individuals were deemed ineligible.

Local election staff have raised specific concerns about the quality of the data. Officials in Los Angeles stated that a high percentage of the people on the list were born in the United States. Governor Gavin Newsom criticized the effort on social media, calling it an absolute clown show. He pointed out that the lists included people who never voted and voters from the wrong county.

Congressman Pete Aguilar, who represents southwest San Bernardino County, joined the criticism. He wrote that voter intimidation has no place in the democracy. The state’s legal team has moved to challenge the deadline, citing the rapidly approaching election. Some state officials initially took no action on the Friday letters, which triggered a legal fight with the federal government.

The conflict extends to recent prosecutions. The Justice Department recently charged 28 foreign nationals with fraudulently registering to vote. Bill Essayli, the first assistant U.S. attorney, said the arrests prove California is mailing ballots to noncitizens. The defendants are lawful permanent residents who hold legal status in the U.S. but are not citizens. An appeals court is scheduled to hear the matter on Tuesday.
